Importers Subject to New User Fees Under EPA Proposal
The Environmental Protection Agency is proposing to establish and collect user fees from manufacturers (including importers) and processors that (i) are required to submit information under Section 4 of the Toxic Substances Control Act; (ii) submit a notice, exemption or other information under TSCA Section 5; or (iii) manufacture (including import) a chemical substance that is the subject of a risk evaluation under TSCA Section 6(b). The EPA also proposes to amend long-standing user fee regulations governing the review of pre-manufacture notices, exemption applications and notices, and significant new use notices. Moreover, this rule would establish standards for determining which persons qualify as small business concerns and are thus subject to lower fee payments. Comments on this proposed rule are due by 27 April.
