Miscellaneous Canadian and Latin American AD/CV Actions on Chinese Products

Brazil Begins AD Investigations on Polyurethane Laminate, Certain Wire and Certain Flat-Rolled Steel Products
The Brazilian government has initiated separate AD investigations of the following mainland Chinese products:

  • polyurethane laminate with textile material on one side classified under NCM 3921.13.90, 3921.90.19, 3921.90.90, 5603.14.10, 5603.14.20, 5603.14.30, 5603.14.40, 5603.14.90, 5603.94.10, 5603.94.20, 5603.94.30, 5603.94.90 and 5903.20.00;
  • flat-rolled products of alloy or non-alloy steel, of a width of 600 mm or greater, hot-rolled, in plates of a thickness of less than 4.75 mm or in coils of any thickness, classified under NCM 7208.10.00, 7208.25.00, 7208.26.10, 7208.26.90, 7208.27.10, 7208.27.90, 7208.36.10, 7208.36.90, 7208.37.00, 7208.38.10, 7208.38.90, 7208.39.10, 7208.39.90, 7208.40.00, 7208.53.00, 7208.54.00, 7208.90.00, 7225.30.00 and 7225.40.90;
  • high-carbon steel stranded wire, with a high tensile strength and low relaxation, having three or seven wires, also known as low relaxation strand or pre-stressed concrete strand, classified under NCM 7312.10.90; and
  • high-carbon, high-resistance steel wire, of circular section, hardened by cold drawing, having a smooth or notched surface and normal or low relaxation, classified under NCM 7217.10.19 and 7217.10.90.  

Brazilian authorities will send questionnaires to any known producers and exporters, which will have 30 days to complete and return them.

Mexico Issues AD Duty Order on Steel Wire Rod
Mexico’s Ministry of Economy has issued an AD duty order on mainland Chinese steel wire rod classified under HTSMX 7213.10.01, 7213.20.01, 7213.91.01, 7213.91.02, 7213.99.01, 7213.99.99, 7227.10.01, 7227.20.01, 7227.90.01 and 7227.90.99. Included within the scope of this investigation are both definitive and temporary importations of subject merchandise as well as steel wire rod imported within the framework of Mexico’s “Eight Rule” mechanism under HTSMX 9802.00.01, 9802.00.07, 9802.00.13, 9802.00.19 and 9802.00.23. Imports of subject merchandise will be subject to an AD duty of US$0.49/kg for a period of five years.

Mexico Preliminarily Finds Dumping on Certain Corrosion-Resistant Steel Products
The Ministry of Economy recently issued a preliminary affirmative determination in its AD investigation of certain mainland Chinese flat-rolled corrosion-resistant steel products classified under HTSMX 7210.30.01, 7210.30.99, 7210.41.01, 7210.41.99, 7210.49.01, 7210.49.02, 7210.49.03, 7210.49.04, 7210.49.99, 7210.61.01, 7210.70.01, 7210.70.99, 7212.20.01, 7212.20.02, 7212.20.99, 7212.30.01, 7212.30.02, 7212.30.99, 7212.40.03, 7212.40.99, 7225.91.01, 7225.92.01, 7226.99.01 and 7226.99.02. These products may also be entered under special tariff lines 9802.00.01, 9802.00.02, 9802.00.03, 9802.00.04, 9802.00.06, 9802.00.07, 9802.00.10, 9802.00.13, 9802.00.15 and 9802.00.19. Imports of subject merchandise will preliminarily be subject to the following AD duties effective from 30 July.

Argentina Continues AD Probe of Certain Motor Vehicle Equipment
Argentinean authorities have decided to proceed to the final phase of the investigation of mainland Chinese evaporators and condensers of the type used in automobile air conditioning equipment and radiators for automobiles and tractors classified under NCM 8708.91.00 and 8418.99.00. No provisional AD measures have been imposed of subject merchandise, however.

Canada Begins Sunset Review of AD/CV Duty Orders on OCTG Pup Joints
Canadian authorities have begun an expiry (i.e., sunset) review of the AD and CV duty orders on mainland Chinese oil country tubular goods pup joints made of carbon or alloy steel, welded or seamless, heat-treated or not heat‑treated, regardless of end finish, having an outside diameter from 2.375 inches to 4.5 inches (60.3 to 114.3 mm), in all grades, in lengths from two to 12 feet (61 to 366 cm), excluding casing pup joints, classified under HTSCA 7304.29.0051, 7304.29.0059, 7304.29.0061, 7304.29.0069, 7304.29.0071 and 7304.29.0079.

The Canada Border Services Agency will accept questionnaire responses and other information from interested parties through 9 September and will issue its determination by 30 November. In the event of a positive determination, the Canadian International Trade Tribunal will determine by 7 April 2017 whether the continued or resumed dumping is likely to result in injury or retardation. The CITT will hold a public hearing in connection with this review on 20 February 2017.

Brazil Launches Sunset Review on Vacuum Flasks
Brazil has initiated a sunset review of the AD duty order on mainland Chinese vacuum flasks classified under NCM 9617.00.10. Imports of subject merchandise have been subject to an AD duty of 47 percent since July 1999.

Brazil Begins Scope Review of AD Duty Order on Loudspeakers
Brazilian authorities have initiated a review to determine whether certain Bluetooth wireless speakers fall within the scope of the AD duty order on mainland Chinese loudspeakers classified under NCM 8518.21.00 and 8518.22.00.

Brazil Issues Results of Anti-Circumvention Probes of Ceramic Tableware
Brazilian authorities recently issued final determinations in two additional anti-circumvention probes of the AD duty order on mainland Chinese ceramic tableware classified under NCM 6911.10.10, 6911.10.90, 6911.90.00 and 6912.00.00. MDIC has determined that import licences should not be issued to imports of subject tableware claiming to be produced in India by Premier Ceramic Industries but should be issued to imports of subject merchandise claiming to be produced in Thailand by Raja Porcelain Co. Ltd.

Brazil Announces Schedule for AD Sunset Review on Knitted Fabric of Viscose Fibres
Brazilian authorities launched about four months ago a sunset review of the AD duty order on mainland Chinese knitted fabric of viscose fibres, whether or not incorporating elastane, classified under NCM 6004.10.41, 6004.10.42, 6004.10.43, 6004.10.44, 6004.90.40, 6006.41.00, 6006.42.00, 6006.43.00 and 6006.44.00. Imports of subject merchandise have been subject to an AD duty of US$4.10/kg since April 2011. The next steps in this proceeding are as follows: closure of evidential phase of investigation (16 November), deadline for data and information contained in the file (6 December), issuance of technical note with essential facts under analysis to be considered in the final determination (16 December), deadline for presentation of final submissions by interested parties and end of instruction phase (5 January 2017), and issuance by DECOM of final determination (16 January 2017). Brazilian authorities have also announced their intention to use South Korea as the surrogate market economy country in this proceeding.

Brazil Extends Deadline for Final AD Determination on Certain Carbon Steel Pipe
Brazilian authorities recently extended for a period of up to eight months, from 14 July 2016 to 14 March 2017, the deadline to issue a final determination in their AD investigation of mainland Chinese seamless carbon steel pipe of circular cross section, with an outside diameter not exceeding 374 mm, classified under NCM 7304.31.10, 7304.31.90, 7304.39.10, 7304.39.20 and 7304.39.90.
