Miscellaneous Canadian and Latin American AD/CV Actions on Mainland Chinese Products

Brazil Issues Preliminary Affirmative Determination in CV Probe of Steel Flat-Rolled Products
Brazil has issued a preliminary affirmative determination in its CV duty investigation of mainland Chinese hot-rolled flat-rolled products of alloy or non-alloy steel, of a width of 600 mm or greater, in plates of a thickness of less than 4.75 mm or in coils of any thickness, classified under NCM 7208.10.00, 7208.25.00, 7208.26.10, 7208.26.90, 7208.27.10, 7208.27.90, 7208.36.10, 7208.36.90, 7208.37.00, 7208.38.10, 7208.38.90, 7208.39.10, 7208.39.90, 7208.40.00, 7208.53.00, 7208.54.00, 7208.90.00, 7225.30.00 and 7225.40.90. Moreover, the deadline for a final determination has been extended from 21 November 2017 to 21 May 2018.

Brazil Issues Results of Anti-Circumvention Probes of Ball-Point Pens
Brazilian authorities recently issued final determinations in three anti-circumvention probes of the AD duty order on mainland Chinese ball-point pens classified under NCM 9608.10.00. Brazil has determined that import licences should not be issued to imports of subject pens claiming to be produced in India by Saraju Agriways Export Pvt. Ltd., but should be issued to imports of subject pens claiming to be produced in India by Linc Pen & Plastics Ltd. or Rover Writing Instruments.

Argentina Modifies AD Duty on PET Granules
Argentina recently issued the results of its changed circumstances review of the AD duty order on poly(ethylene terephthalate) in granules, with an intrinsic viscosity of 0.70 or more but not more than 0.88 decilitres per gram, from mainland China. The previous AD duty of eight percent has been replaced with a 16 percent duty.

Argentina Issues Results of Anti-Circumventions Review of Sunglasses and Mosaics
Argentina has determined that imports of certain sunglasses classified under NCM 9004.10.00 from Taiwan are not circumventing the AD duty order on subject merchandise from mainland China. In a separate proceeding,

Argentina has determined that imports of certain Venetian mosaics classified under NCM 7016.10.00 from Malaysia are not circumventing the AD duty order on subject merchandise from the mainland.

Argentina Moves to Final Phase of AD Probe on Certain Steel Tube
Argentina has moved to the final phase of its AD duty investigation on mainland Chinese steel tube of the kind used in oil or gas pipelines, whether or not welded, with an external diameter of 406.4 mm or lower and a thickness of 12.7 mm or lower, made in accordance with API 5L/ISO 3183 or any similar standards, except those made of stainless steel, classified under NCM 7304.19.00 and 7306.19.00.

Argentina Begins Sunset and Changed Circumstances Review of AD Duty Order on Coated Paper
Argentina has initiated a sunset and changed circumstances review of the AD duty order on certain sunglasses, corrective or pre-graduated spectacles, and frames and mountings of spectacles classified under NCM 9003.11.00, 9003.19.10, 9003.19.90, 9004.90.10 and 9004.10.00 from mainland China. Imports of subject merchandise have been subject to AD duties ranging from US$13.09 to US$16.88 per unit since October 2012.

Canada Begins Sunset Review of AD/CV Duty Orders on Steel Plate
Canadian authorities have begun an expiry (i.e., sunset) review of the AD duty order on mainland Chinese hot-rolled carbon steel plate and high‑strength low-alloy plate not further manufactured than hot-rolled, heat-treated or not, in cut lengths, in widths from 24 inches (+/‑ 610 mm) to 152 inches (+/- 3,860 mm) inclusive, and thicknesses from 0.187 inches (+/‑ 4.75 mm) to 4.0 inches (+/- 101.6 mm) inclusive, but excluding plate for use in the manufacture of pipe and tube (also known as skelp), plate in coil form, plate having a rolled, raised figure at regular intervals on the surface (also known as floor plate), and plate produced to American Society for Testing and Materials specifications A515 and A516M/A516, grade 70 (also known as pressure vessel quality plate) in thicknesses greater than 3.125 inches (+/- 79.3 mm). Imports of subject merchandise are classified under HTSCA 7208.51.0010, 7208.51.0091, 7208.51.0092, 7208.51.0093, 7208.51.0094, 7208.51.0095, 7208.52.0010, 7208.52.0091, 7208.52.0092, 7208.52.0093 and 7208.52.0096.

The Canada Border Services Agency will accept questionnaire responses and other information from interested parties through 9 November 2017 and will issue its determination by 2 March 2018. In the event of a positive determination, the CITT will determine by 9 August 2018 whether the continued or resumed dumping or subsidising is likely to result in injury or retardation. The CITT will hold a public hearing in connection with this review on 28 May 2018.
