Miscellaneous Canadian and Latin American AD/CV Actions on Mainland Chinese Products

Canada Makes Determination in AD/CV Sunset Review of Standard Pipe
The Canada Border Services Agency has issued a final affirmative dumping and countervailable subsidy determination in its expiry review of the AD and CV duty orders on certain carbon steel welded pipe commonly identified as standard pipe. Subject merchandise includes pipe in the nominal size range of half an inch up to and including six inches (12.7 mm to 168.3 mm in outside diameter) inclusive, in various forms and finishes, usually supplied to meet ASTM A53, ASTM A135, ASTM A252, ASTM A589, ASTM A795, ASTM F1083 or Commercial Quality, or AWWA C200-97 or equivalent specifications, including water well casing, piling pipe, sprinkler pipe and fencing pipe, but excluding certain pipe. If the Canadian International Trade Tribunal issues an affirmative injury determination, these AD and CV duty orders will be renewed for an additional five years. If, on the contrary, the CITT issues a negative determination, the orders will be rescinded. The CITT determination is expected by 28 March 2019.

Canada Begins Sunset Review of AD/CV Orders on Silicon Metal. Canadian authorities have begun an expiry (i.e., sunset) review of the AD and CV duty orders on mainland Chinese silicon metal containing at least 96.00 percent but less than 99.99 percent silicon by weight, as well as silicon metal containing between 89.00 percent and 96.00 percent silicon by weight that contains aluminium greater than 0.20 percent by weight, of all forms and sizes, classified under HTSCA 2804.69.0000. The CBSA will accept questionnaire responses and other information from interested parties through 22 November 2018 and will issue its determination by 15 March 2019. In the event of a positive determination, the CITT will determine by 22 August 2019 whether the continued or resumed dumping or subsidisation is likely to result in injury or retardation. The CITT will hold a public hearing in connection with this review on 10 June 2019.

Canada Issues Preliminary Results of AD/CV Scope Proceeding on Fabricated Steel Components
The CBSA has preliminarily determined in a scope proceeding involving the AD and CV duty orders on certain fabricated steel components from mainland China that certain liquified natural gas modules, including pipe rack modules, are within the scope of these orders. The scope proceeding is expected to be completed by 23 November.

Brazil Preliminarily Finds Dumping on Cast Iron Pipe
DECOM has issued a preliminary affirmative dumping and injury determination in its AD investigation of certain mainland Chinese cast iron pipe classified under NCM 7303.00.00. Brazil’s Foreign Trade Chamber (CAMEX) will next decide whether to apply provisional AD measures on subject merchandise.

Brazil Terminates AD Price Undertaking on Tableware. Brazil has terminated the AD price undertaking it had in place for certain companies associated with the China Ceramics Industrial Association. As a result, these companies will now face the AD measures in place on mainland Chinese porcelain and ceramic tableware classified under NCM 6911.10.10, 6911.10.90, 6911.90.00 and 6912.00.00, shown below.
