The USITC has issued a final affirmative injury determination in its sunset review of the AD duty order on cased pencils from mainland China. As a result, this order will be extended for another five years.
Comments Sought on Possible Remedies in IPR Probe of Hand Dryers
The USITC initiated on 1 August 2016 a Section 337 investigation of certain hand dryers and housings for hand dryers from mainland China. The administrative law judge in charge of this proceeding subsequently found the six remaining respondents in default based on their failure to respond to the complaint and notice of investigation. The USITC has determined to review the ALJ’s analysis and findings with respect to the existence of a domestic industry and is seeking comments on the form of remedy, if any, that should be ordered in connection with this investigation. If some form of remedy is ordered, USTR would have 60 days to approve or disapprove the USITC’s action.
