Termination of Various AD/CV Sunset Reviews. The USITC has terminated its sunset reviews of the following AD and/or CV duty orders from mainland China because it did not receive a notice of intent to participate from the relevant domestic interested parties: certain off-the-road tyres (AD/CV), freshwater crawfish tail meat (AD) and pre-stressed concrete steel rail tie wire (AD).
New IPR Probes on LED Products. The USITC has instituted separate investigations to determine whether imports of certain light-emitting diode products, systems and components thereof from various sources, including Hong Kong and mainland China, are violating Section 337 of the 1930 Tariff Act by reason of (i) patent infringement or (ii) false advertising and patent infringement. The scope of the investigations covers (i) LED downlights and LED luminaries, and (ii) LED packages and assemblies, LED luminaries and connected smart LED lighting systems and components thereof. The complainants request that after these investigations the USITC issue limited exclusion orders as well as cease and desist orders.
New IPR Probe on Touch-Controlled Mobile Devices. The USITC has instituted an investigation to determine whether imports of certain touch-controlled mobile devices, including smartphone and tablet devices, computers (including notebook and laptop computers) and associated components thereof from mainland China and South Korea are violating Section 337 of the 1930 Tariff Act by reason of patent infringement. The complainant requests that after this investigation the USITC issue a limited exclusion order as well as cease and desist orders.
Remedies in IPR Probe of Mounting Apparatuses for Holding Electronic Devices. The USITC has imposed a general exclusion order in the Section 337 investigation of certain mounting apparatuses for holding portable electronic devices and components thereof from mainland China. Additionally, the USITC has set at 100 percent of entered value the bond amount under which infringing goods may continue to enter the United States during the 60-day period the president has to review the USITC’s remedy.
IPR Probe on Storage Drives Terminated. The USITC has terminated based on a settlement agreement its Section 337 probe on solid state storage drives, stacked electronic components and products containing the same from various sources, including mainland China.
IPR Probe on Nicotine Delivery Systems Amended. The USITC has decided not to review a decision by the administrative law judge in the on-going Section 337 investigation of certain electronic nicotine delivery systems and components thereof from mainland China to amend the complaint and notice of investigation to correct the name of one respondent.
