Preliminary Affirmative AD/CV Injury Determinations on HEDP
The USITC has issued preliminary affirmative injury determinations in its AD and CV investigations of mainland Chinese 1-hydroyethylidene-1, 1-disphosphonic acid (HEDP). As a result, the DOC will continue its AD and CV duty investigations of imports of subject merchandise. The DOC is scheduled to issue its preliminary CV determination on 24 June and its preliminary AD determination on 7 September.
Expedited Sunset Reviews of AD Duty Orders on Cooking Ware and Alloy Magnesium
The USITC has decided to conduct expedited sunset reviews of the AD duty orders on porcelain-on-steel cooking ware and alloy magnesium from mainland China. The reviews will seek to determine whether revocation of these orders would be likely to lead to continuation or recurrence of material injury to a domestic industry within a reasonably foreseeable time. As opposed to full reviews, expedited reviews do not include a public hearing or the issuance of questionnaires.
New Section 337 Investigation on Composite Cores
The USITC has launched a Section 337 patent infringement investigation of certain mainland Chinese electrical conductor composite cores and components thereof used in overhead electrical transmission lines. The complainant is requesting the USITC to issue a general exclusion order (or alternatively a limited exclusion order) as well as cease and desist orders.
New Section 337 Investigation on Portable Electronic Devices
The USITC has launched a Section 337 patent infringement investigation of certain portable electronic devices and components thereof from various sources, including mainland China. The products at issue in this proceeding are portable electronic devices, such as smart phones, with the capability of playing stored media files selected by a user from a hierarchical display. The complainants are requesting the USITC to issue exclusion and cease and desist orders.
New Section 337 Probe on Breathing Treatment Systems
The USITC has initiated a Section 337 patent infringement investigation of certain mainland Chinese sleep-disordered breathing treatment systems and components thereof. The complainants are requesting the USITC to issue limited exclusion and cease and desist orders.
Section 337 Investigation of Touchscreen Controllers Terminated
The USITC on 26 May 2015 instituted a Section 337 investigation of certain touchscreen controllers and products containing the same from mainland China. On 29 March, the complainant and the respondent in this investigation filed a joint motion to terminate the investigation based on a settlement agreement. The administrative law judge assigned to this case subsequently granted the complainant’s motion and the USITC has decided not to review this decision.
