Final Affirmative AD/CV Injury Determination on Cold-Rolled Steel Flat Products

As a result, the DOC will issue AD and CV duty orders on imports of subject merchandise.

The USITC also made negative critical circumstances findings with regard to imports of these products from mainland China. As a result, subject goods that entered the United States from the mainland prior to 22 December 2015 will not be subject to retroactive CV duties, while subject goods that entered the United States prior to 7 March 2016, will not be subject to retroactive AD duties.

AD Duty Order on Alloy Magnesium Renewed
The USITC has issued a final affirmative injury determination in its sunset review of the AD duty order on alloy magnesium from mainland China. As a result, this order will be extended for another five years.

Seventh Annual Compilation of Reports on Textile and Apparel Imports from Mainland China
The USITC released on 13 June its seventh annual compilation of bi-weekly reports on the volume, value, unit value and import market share of imports from mainland China that were subject to the provisions of the 2005 U.S.-China Memorandum of Understanding Concerning Trade in Textiles and Apparel. The data in this report is shown on an annual and quarterly basis by category and by Harmonised Tariff Schedule 10-digit subheadings. By category, annual data are provided from 2008 through 2015 and quarterly data are provided from first quarter 2014 through fourth quarter 2015. By HTS10 subheading, annual data are provided from 2013 through 2015 and quarterly data are provided from first quarter 2014 through fourth quarter 2015.

Scheduling of Final Phase of AD and CV Injury Investigation of Mechanical Transfer Drive Components
The USITC has scheduled the final phase of its AD and CV injury investigation of iron mechanical transfer drive components from mainland China. The pre-hearing staff report will be placed in the non-public record on 4 October and a public version will be issued thereafter; pre-hearing briefs are due by 11 October; requests to appear at the hearing must be submitted by 12 October; the pre-hearing conference will take place on 17 October; the hearing will be held on 18 October; and post-hearing briefs are due by 25 October.

Scheduling of Sunset Reviews of AD Duty Orders on Pipe Fittings, Iron Construction Castings and Copper Pipe
The USITC has scheduled the sunset reviews of the AD duty orders on mainland Chinese carbon steel butt-weld pipe fittings (expedited review), iron construction castings (full review), seamless refined copper pipe and tube (full review). The reviews will seek to determine whether revocation of these orders would be likely to lead to continuation or recurrence of material injury to a domestic industry within a reasonably foreseeable time.

In the case of the expedited review of pipe fittings, the applicable staff report will be placed in the non-public record on 30 June and a public version will be issued thereafter. Comments and statements are due by 6 July and may not contain new factual information.

The full review on iron construction castings will be carried out in accordance with the following schedule: the pre-hearing staff report will be placed in the non-public record on 3 October and a public version will be issued thereafter; pre-hearing briefs and requests to appear at the hearing are due by 11 October; the pre-hearing conference will be held on 13 October; the hearing will be held on 20 October; and post-hearing briefs are due by 31 October.

Finally, the full review on certain copper pipe and tube will be carried out in accordance with the following schedule: the pre-hearing staff report will be placed in the non-public record on 22 September and a public version will be issued thereafter; pre-hearing briefs are due by 30 September; requests to appear at the hearing are due by 3 October; the pre-hearing conference will be held on 7 October; the hearing will be held on 11 October; and post-hearing briefs are due by 20 October.

Scheduling of Full Sunset Reviews of AD/CV Duty Orders on Coated Paper
The USITC has scheduled the sunset reviews of the AD and CV duty orders on mainland Chinese coated paper suitable for high-quality print graphics using sheet-fed presses, which will adhere to the following schedule: the pre-hearing staff report will be placed in the non-public record on 11 October and a public version will be issued thereafter; pre-hearing briefs are due by 19 October; requests to appear at the hearing are due by 20 October; the pre-hearing conference will be held on 26 October; the hearing will be held on 27 October; and post-hearing briefs are due by 4 November.

New Section 337 Investigation on Certain Inflatable Products
The USITC has initiated a Section 337 investigation of certain inflatable products with tensioning structures and processes for making the same from Hong Kong and mainland China. The products at issue in this investigation are inflatable products, such as air mattresses, with internal tensioning structures that help maintain the intended shape of the product. The complainants allege that the respondents are infringing certain U.S. patents and are requesting the USITC to issue a limited exclusion order as well as a cease and desist order.

New Section 337 Investigation on Various Medical Devices
The USITC has initiated a Section 337 investigation of certain carbon spine boards, surgical collars, CPR masks and various medical training manikin devices, as well as trademarks, copyrights of product catalogues, product inserts and components thereof from mainland China. The complainants allege that the respondents are infringing certain patent, copyright, trademark and trade dress rights and are requesting the USITC to issue a general exclusion order (or, alternately, a limited exclusion order) as well as cease and desist orders.
