Scheduling of Final Phase of AD/CV Injury Investigations of Rubber Bands
The USITC has scheduled the final phase of its AD and CV injury investigations of rubber bands from mainland China. The pre-hearing staff report will be placed in the non-public record on 30 October and a public version will be issued thereafter; pre-hearing briefs are due by 6 November; requests to appear at the hearing are due by 7 November; the pre-hearing conference will be held on 9 November; the hearing will be held on 13 November; post-hearing briefs are due by 20 November; and final comments are due by 11 December.

Scheduling of Final Phase of AD/CV Injury Investigations of Cast Iron Soil Pipe
The USITC has scheduled the final phase of its AD and CV injury investigations of cast iron soil pipe from mainland China. The pre-hearing staff report will be placed in the non-public record on 13 December and a public version will be issued thereafter; pre-hearing briefs are due by 20 December; requests to appear at the hearing are due by 10 January 2019; the pre-hearing conference will be held on 11 January 2019; the hearing will be held on 15 January 2019; post-hearing briefs are due by 22 January 2019; and final comments are due by 11 February 2019.

Scheduling of Full Sunset Review of AD/CV Duty Orders on Wind Towers
The USITC has scheduled the full sunset review of the AD and CV duty orders on utility scale wind towers from mainland China. The pre-hearing staff report will be placed in the non-public record on 18 December and a public version will be issued thereafter; pre-hearing briefs are due by 10 January 2019; requests to appear at the hearing are due by 16 January 2019; the pre-hearing conference will be held on 18 January 2019; the hearing will take place on 24 January 2019; and post-hearing briefs are due by 31 January 2019.

Remedy Comments Sought in Section 337 Probe of Vacuum Cleaning Devices
In its Section 337 investigation of certain robotic vacuum cleaning devices and components thereof such as spare parts from various sources, including mainland China, the USITC has determined to review various aspects of the administrative law judge’s finding that the importation, sale for importation and sale within the United States after importation of such goods are infringing patents asserted by the complainant. The ALJ recommended that the USITC issue limited exclusion orders against the infringing products and a cease and desist order against the respondents. 

The USITC is now inviting comments through 24 September on (i) the form of remedy, if any, that should be ordered in this investigation; (ii) the effects of any such remedy on public health and welfare, competitive conditions in the U.S. economy, domestic production of articles that are like or directly competitive with those that are subject to the investigation, and U.S. consumers; and (iii) the amount of the bond under which infringing articles may continue to enter the United States during the 60-day period the president has to review any USITC-ordered remedy. The USITC is also asking the complainant to provide the dates that the patents at issue expire, the HTSUS numbers under which the accused articles are imported, and a list of known importers of the accused products. Finally, the USITC has extended until 20 November the target date for completion of this investigation.
