Scheduling of AD/CV Injury Investigations on Polyester Textured Yarn. The USITC has released the schedule for the preliminary phase of its AD and CV injury investigations on polyester textured yarn from mainland China. Return questionnaires are due by 1 November, requests to appear at the pre-hearing conference are due by 6 November, the pre-hearing conference will be held on 8 November, written submissions must be filed by 14 November and a preliminary injury determination will be issued by 3 December.

AD Duty Orders on Rebar, Xanthan Gum and Sodium Hexametaphosphate Renewed. The USITC has issued separate final affirmative injury determinations in its sunset reviews of the AD duty orders on steel concrete reinforcing bar, xanthan gum and sodium hexametaphosphate from mainland China. As a result, these orders will be extended for another five years.

Remedy Input Sought in Section 337 Probe of Insulated Beverage Containers. In its patent, trademark and copyright infringement investigation of certain insulated beverage containers, components, labels and packaging materials thereof from Hong Kong and mainland China, the USITC has found two respondents in default and terminated the investigation with respect to the remaining three respondents. The USITC is therefore inviting comments by 5 November on (1) the form of remedy, if any, that should be ordered; (2) the effect of any such remedy on the public health and welfare, competitive conditions in the U.S. economy, U.S. production of articles that are like or directly competitive with those that are subject to investigation, and U.S. consumers; and (3) the amount of the bond under which infringing articles could continue to enter the United States during the 60-day period the president has to review any USITC-ordered remedy. The USITC has also found two respondents in default and terminated the investigation with respect to the three remaining respondents.

Revised Schedule of Full Sunset Review of AD/CV Duty Orders on Solar Cells and Modules. The USITC recently issued a revised schedule for the on-going full sunset review of the AD and CV duty orders on crystalline silicon photovoltaic cells and modules from mainland China. The pre-hearing staff report will be placed in the non-public record on 2 November and a public version will be issued thereafter; pre-hearing briefs are due by 13 November; requests to appear at the hearing are due by 16 November; the pre-hearing conference will be held on 20 November; the hearing will take place on 27 November; post-hearing briefs are due by 4 December; and final party comments are due by 4 January 2019.
