Remedies Issued in Section 337 Probe of Two-Way Radios
The USITC has issued a limited exclusion order prohibiting the unlicensed entry of certain two-way radio equipment and systems, related software and components thereof from mainland China that infringe one or more of specific patent claims and are manufactured abroad or imported by or on behalf of one respondent or any of its affiliated companies, parents, subsidiaries or other related business entities, or their successors or assigns. The USITC has also issued cease and desist orders prohibiting two respondents from importing, selling, marketing, advertising, distributing, offering for sale, transferring (except for exportation), and soliciting U.S. agents or distributors for infringing goods. Finally, the USITC has determined that a bond of 44 percent of the entered value is required to permit temporary importation of infringing goods during the 60-day period the president has to review this remedy.
